The basics
The Primer Wand, LLC (“we”) operates theprimerwand.com and sells the Primer Wand and related accessories. By placing an order, you confirm you're at least 18 years old and shopping for professional or personal use.
Orders & payment
- Prices and availability can change without notice.
- We reserve the right to refuse or cancel any order — for example, if the listed price was wrong.
- Payment is processed at checkout through Shopify Payments / Stripe.
Shipping & returns
See our Shipping & Returns page. Risk of loss transfers to you when the carrier delivers the package to the shipping address.
Warranty
The Primer Wand comes with a 30-day no-spill guarantee: if it ever spills primer in normal use within the first 30 days, we replace it free. After that, we'll work with you on a fair resolution if a wand fails before its useful life — email hello@theprimerwand.com.
We do not warrant against misuse, modification, drops from extreme heights, or use with non-PVC/CPVC chemicals the wand isn't designed for.
Acceptable use
Don't scrape the site, abuse the cart/checkout, or use our marks without permission. Don't reverse-engineer the wand for commercial cloning — it's patent-pending (#63/843691).
Testimonials & reviews
Customer quotes and reviews displayed on this site are real and used with permission. If you submit a review or testimonial, you grant us a non-exclusive, royalty-free license to display it (with your first name and city, no last name or contact details) on our website and marketing materials. You can revoke this license at any time by emailing hello@theprimerwand.com.
DMCA / copyright notices
If you believe content on this site infringes your copyright, send a DMCA notice with all required elements to hello@theprimerwand.com with subject line “DMCA notice.” We'll respond promptly per 17 U.S.C. § 512.
Indemnification
You agree to indemnify and hold us harmless from any claim, damage, or expense (including reasonable legal fees) arising from your misuse of a product, breach of these terms, or violation of any law or third-party right.
Force majeure
We're not liable for delays or failures caused by events outside our reasonable control — carrier strikes, natural disasters, government actions, supply-chain disruptions, or similar.
Liability
To the maximum extent allowed by law, our total liability for any claim related to this site or our products is limited to the amount you paid us in the past 12 months. We are not liable for indirect or consequential damages.
Disputes
We try to resolve disputes informally first — email hello@theprimerwand.com and we'll work it out. If that fails, any unresolved dispute will be settled in the state or federal courts of Harris County, Texas, under Texas law (without regard to conflict-of-laws principles). You and we both waive any right to a jury trial.
Note: many DTC brands require binding arbitration with a class-action waiver here. We don't today — you keep your day-in-court rights. Tell counsel whether to swap that in before launch if you want the standard ecommerce defense posture.
Severability & entire agreement
If any part of these terms is found unenforceable, the rest stays in effect. These terms (together with our Privacy Policy and Shipping & Returns page) are the entire agreement between you and us regarding the site and our products, replacing any prior agreement on the same subject.
Changes
We may update these terms. The “Effective” date above will change when we do, and we'll email registered customers when changes are material. Continuing to use the site after a change means you accept the new version.
